Erebus withdraws Brown Race 32 penalty appeal

Erebus Motorsport has withdrawn its intent to appeal Will Brown’s Race 32 penalty.

Brown was handed a time penalty over an incident with Scott Pye late in the race.

Pye and Brown were behind Mark Winterbottom and Cam Waters heading into the final corner complex.

Winterbottom passed Waters, causing Pye and Brown to check up behind.

Pye was unloaded into the tyre barriers, with Brown later handed a 15-second time penalty for a driving infringement.

Brown crossed the line in eighth, three positions behind teammate Brodie Kostecki.

Brown and Pye were classified 11th and 12th, the latter also picking up a penalty for a Safety Car restart infringement.

It was confirmed Monday morning that Erebus had lodged an intent to appeal.

Supercars Driving Standards Advisor Craig Baird confirmed to that Erebus' intent to appeal had been withdrawn.

According to Rule B7.7.1 in the Operations Manual, "there is no right of Appeal against a determination for which a Penalty has been applied in accordance with Rule B7.7.1”.

That rule most notably came into play when Triple Eight attempted to overturn Jamie Whincup’s time penalty in the 2016 Bathurst 1000.

At the 2017 Newcastle finale, DJR Team Penske was also unable to appeal an in-race time penalty for Scott McLaughlin.

Erebus CEO Barry Ryan praised his drivers, and suggested the rule be amended in future.

“Ridiculous that a team cannot simply ask about an in-race penalty,” Ryan told

“The system needs to change as people do make mistakes, even officials.

“This is a perfect example of a racing incident, not a charge accusing the driver of incompetence.

“Brodie and Will raced their arses off and they both crossed the line in the top eight.

“We’ve always been proud of how hard Brodie and Will race, and they did the team and our fans proud this weekend."

The 2022 Repco Supercars Championship will conclude on the Adelaide streets in December.
